Terms of Use

These Terms govern your use of the Android game Tormentful Depths (the "Game"), provided by SanfyStudios ("we", "us"), an independent developer based in Italy. By downloading or playing the Game you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Game.
1. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and play the Game for personal, non-commercial entertainment, subject to these Terms and to the Google Play Terms of Service.
2. Testing releases
The Game may be distributed to you through a Google Play testing track. Test builds are pre-release: they may contain defects, may lose your saved progress, and may be changed or withdrawn at any time without notice.
3. Restrictions
You agree not to reverse engineer, decompile, or modify the Game except to the extent such restriction is prohibited by applicable law; not to cheat, exploit, or interfere with the Game, its purchases, or its advertising; and not to use the Game for any unlawful purpose.
4. Advertising
The Game is supported by advertising provided by Google AdMob, including an interstitial shown after a run ends and an optional rewarded ad you may choose to watch. Ad availability and ad content are supplied by third parties and are not guaranteed. See the Privacy Policy for data and consent details.
5. Purchases
The Game offers a one-time "Remove Ads" in-app purchase, sold and processed by Google Play. Purchases are subject to Google Play's terms and refund policy; refunds are handled by Google. Removing ads disables the automatic interstitial; the optional rewarded revive ad remains available because you choose to watch it.
If you are a consumer in the EU, your statutory right of withdrawal applies as provided by law; by starting to use digital content immediately you may be asked to acknowledge that this right lapses on delivery.
6. Health and safety
The Game contains flashing lights, rapid movement, and high-contrast effects. Read the in-game Photosensitivity Warning (shown on first launch and available again under Settings → Health & Safety) before playing. Stop playing and consult a doctor if you experience dizziness, altered vision, twitching, disorientation, or convulsions.
7. Intellectual property
The Game and all of its content — code, art, audio, names, and design — are owned by us or our licensors and are protected by intellectual-property law. © 2026 SanfyStudios. All rights reserved.
8. Disclaimers
To the fullest extent permitted by law, the Game is provided "as is" and "as available" without warranties of any kind. We do not warrant that the Game will be uninterrupted, error-free, or compatible with every device. Mandatory consumer guarantees under Italian and EU law are not excluded.
9. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for loss of data or saved progress, arising from your use of the Game. Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud, or for wilful misconduct or gross negligence.
10. Updates and termination
We may update, suspend, or discontinue the Game or these Terms at any time. Continued use after a change means you accept the updated Terms. We may end your licence if you breach these Terms.
11. Governing law
These Terms are governed by the laws of Italy, without regard to conflict-of-law rules. If you are a consumer, you keep the protection of the mandatory provisions of the law of your country of residence and may bring proceedings in the courts there; otherwise the courts of Italy have jurisdiction.
